Abstract

The scientific article notes that Russian aggression against Ukraine began back in 2014 with the illegal occupation of the Crimean peninsula by the Russian Federation. It is from this moment that almost every day in Ukraine, the Russian military conducts airstrikes on objects of military and civilian infrastructure, etc., and it is also observed that they commit socially dangerous acts unacceptable for a healthy human psyche, in particular, intentional murders, rapes, sexual violence, torture, robbery , abductions, deportations, which especially intensified in Borodyanka, Buchi, Gostomel, Irpen, Mariupol, etc. after the start of the full-scale invasion of the Russian Federation on the territory of Ukraine, which took place on February 24, 2022. In this regard, the question immediately arises regarding the qualification of the above-mentioned acts committed by the Russian aggressors in Ukraine against the civilian population, namely, the clarification of the presence or absence of elements of genocide in their behavior. For this purpose, the authors analyzed the provisions of a number of international legal acts, as well as the current Criminal Code of Ukraine, which regulate the issue of responsibility for genocide, based on the results of which appropriate conclusions were drawn.
